The service committee met with the Comex team on October 17 to discuss several subjects and concerns.

Note that since this meeting, the company has imposed the return of sparkling wine service on the ground. The committee and the component disagree with this service, even though an agreement had been reached with Comex to reduce ground service to a minimum on flights on the A321neo LR club SOUTH at 4 cabin crew!

As you already know, our requests will be studied by the company and will not necessarily all be accepted. Here are some examples of what we discussed.

Regarding the coffee and tea service on European flights, we have asked to be able to put the pots on the bar trolleys, as before, for flights after 7:30 p.m. The company wants this to be a seperate service on flights before 9:30 p.m.,

As you may have read in the latest Comex bulletin.For the distribution of Option+ snacks on European flights, we asked to be able to distribute them with the comfort kits and headphones service.

For Club service with the trolley, we discussed at lenght the difficulty of removing the foil on the hot casseroles while balancing with the tray in the cart in the aisle in front of the passengers.

Comex will prepare a document to give us instructions to be able to correctly handle the trays. We also asked for for the Club bar top to be prepared as before, as well as the possibility of removing the wine glass from the small snack trays.We also discuss about Cryopacks to refresh beer and wine, the sparkling water still missing on the A330, the selection of vegeterian meals that the passengers do not like at all, the company’s choice to remove the « end of service » announcement as well as the updating of the CSM etc…Finally we would like to provide and update concerning the following services: (quick reference guide should be available soon)Duty-free A330:L3 and L4A are doing the service with the double trolley in the aisle. They’ll do the « loop ».R2 stay in the galley with the single trolley and is the runner. Close the duty-free.Snack/small breakfast service Europe A321LR:L1 and R4B distributes the snacks together on the single trolley.R3 and L4 double bar with coffee-tea on top.When the snack trolley arrives in the midle of the last cabin R4B leaves L4 finishing the distribution of the snacks and prepare the double trolley bar. Our last two special meetings will be held tomorrow. At these meetings, members will be asked to vote on a strike mandate.

Unlike voting in an election or on a tentative agreement, strike mandates are voted on during special meetings.

Trudeau Government Sides With Big Airlines, Turns Blind Eye to Unpaid Work: CUPE

VANCOUVER, British Columbia–(BUSINESS WIRE)– The federal government says it will turn a blind eye to the issue of unpaid work in the airline sector, where flight attendants work an average of 35 hours unpaid every month, according to a petition response tabled in the House of Commons on Friday by Labour Minister Seamus O’Regan.

 

The petition, submitted by CUPE Airline Division President Wesley Lesosky and signed by over 17,000 Canadians, called on the federal government to close loopholes that allow big airlines to force flight attendants to perform hours of unpaid work every day. O’Regan’s office issued its official response to the petition on November 3, declaring it would be keeping those loopholes open.

 

“These are not the words of a minister who cares about workers being exploited by billion-dollar companies,” said Lesosky. “But now we know whose side Minister O’Regan and Prime Minister Trudeau are really on.”

 

CUPE’s Airline Division launched the Unpaid Work Won’t Fly campaign in April 2023 to draw attention to the issue of mandatory unpaid work within the airline industry, and filed the petition to the House of Commons as part of its campaign.

Lesosky thanked and acknowledged the thousands of CUPE members and citizens across Canada who signed the petition. “Our 18,500 members are engaged and determined, and we will not accept this reality going forward. We never expected this to be an easy fight, but we know this is just the first of many steps, and we know there’s light at the end of the tunnel. We’re going to end this abusive practice with or without the federal government’s help.”

CUPE will be filing complaints through the Canada Industrial Relations Board (CIRB). Lesosky also acknowledged that the federal government’s refusal to act and end this injustice only increases the possibility of job action during future rounds of bargaining.

“Make no mistake: the federal government has chosen its side and failed to address this critical issue, leaving the door open to potential job action in the future which may have a negative impact on the public,” said Lesosky. “We hope the government takes the same hands-off approach in the future if this comes to pass during negotiations at the bargaining table.”

Conciliation Bulletin #1

Monday, October 30th, 2023

The conciliation process is underway. Your bargaining committee met with the two mediators assigned to our case last Wednesday. At this meeting, we established a busy schedule of meetings with the employer for the coming weeks.

Monday October 30th will be the first official day of conciliation at the Canada Federal Employment office in Montreal.

More than ever, in this conciliation period, we must be united and show solidarity. 

We ask all members to proudly wear their CUPE- component « En négociation/ In bargaining »lanyard starting this Monday morning, October 30th!

The lanyards were distributed by our mobilization teams in YYZ and YUL. Thank you to everyone who took part in this mass distribution!

Why wear the lanyards?

To show the employer that you want better working conditions and wages. Every single one of us has a role in collective bargaining.   Wearing the lanyard will show that we are one when your bargaining committee represents you at the  bargaining table.

Are we allowed to wear the union lanyard while in uniform?

In collective bargaining, and even more so in conciliation, jurisprudence has ruled in favor of employees who seek to show their support to their bargaining committee by wearing an official promo item designed by the union. The lanyard is intended to express the unity of the membership and the strenght of being united together. Its message is clear, neutral and in no way detrimental to the employer.

What is the goal of this conciliation?

The purpose of conciliation is to reach a mutually acceptable agreement within 60 days. To achieve this goal, we are assisted by two conciliators appointed by the Federal Mediation and Conciliation Service. The conciliation process can last up to 60 days. The parties may, by mutual agreement, decide to extend this period if necessary.

The 60-day period will end on December 12, 2023, followed by the mandatory 21-day cooling-off period starting on December 13th.

Smartlynx Winter2023-24

Hello,

We’ve received a few questioning messages following the publication of the latest company memo in connection with Smartlynx. We’d like to shed some light on the latest events to hopefully make this situation clearer and more logical for everyone.

Here’s a chronology of events to help us all see more clearly and undo your employer’s imposed perception of your union. You can find a copy of Letter of Understanding 23 at  clicking HERE  and the amendment to Letter of Understanding 23 at  clicking HERE 

– Letter of agreement no. 23 was signed on February 23, 2023.

– The Smartlynx contract began at YYZ in April and was open to all bases at the time. A YUL-based cabin crew member could therefore apply for and remain on the subcontract for the duration of the agreement.

– In May, the employer informed the union of additional positions to be filled.

Discussions then began on how to proceed to fill these positions. The union took the position that pure seniority needed to be respected and therefore the drafting should continue. If  a second posting had been done, it would have put the people that had already applied in the orginal posting, at a disadvantage and unfairness.

The Smartlynx subcontract then continued at YYZ, extending to YUL and entering phase 2.

The employer first approached us about Smartlynx phase 2 in early September. Since then, your union has been quick to make the necessary corrections to ensure that the issues raised at YYZ with phase 1 are not repeated in phase 2. To this end, we signed an Ammendment to LOU 23, which you can find above.

When we signed the ammendment and agreed to all the details, the employer never communicated its intention to separate the recruitment process into 2 phases. Recruitment was to take place in one phase only.

Because of the employer’s approximate manpower requirements since the start of this contract in April, it was impossible for us to know that the positions opened on the September 7 publication did not cover all the requirements of this sub-contract at YUL.

– On September 15, the results are communicated to YUL base cabin crew only.

– On September 26, local 4041 intercepts an e-mail between a YUL SUP and a newly drafted YUL member on Smartlynx, mentioning that the company will be proceeding with a 2nd opening shortly. This is the first time we heard of a 2nd opening.

– On September 26, Local 4041 contacts SEV managers to try to understand what’s going on, and to repair and prevent the nightmare that’s looming on the horizon.

– On September 27, the union takes a firm stand on how to proceed following the company’s error in its original posting: in order to respect YYZ’s way of doing things, which dates back only a few months, article 2.2 of LOU 23 must be respected, and the company must unfortunately draft to fill its needs. All this is confirmed to SEV managers at the same time.

– On September 29, the SEV, to our great surprise and without taking our decision into account, publish’s a 2nd job opening, allowing anyone to apply on Smartlynx, thus creating a huge precedent and, above all, a great deal of potential frustration among our members.

– On September 29, Local 4041 wrote to the SEV manager to ask what he had misunderstood about the union’s position and why a posting for an open position had just been published. Our message was ignored…

– On October 5, the Component sent an initial e-mail to Mr. Teixeira to resolve the problem and ensure that our questions were answered.

– This was followed by several verbal, e-mail and telephone exchanges between the component and the company on the subject.

– We received a formal e-mail from Mr Teixeira on October 10.

– We ask that the error be rectified on October 10 and that a publication explaining the situation be issued by SEV on October 10.

– On October 10, Mr. Teixeira replies that our request will be respected, but that the SEV will make no communication.

– We were in negotiation preparation days on October 11-12 and 13, and therefore unable to action Smartlynx. However, we asked the company to respect the of opening positions to YYZ cabin crew, as that was not done during the first posting. YYZ cabin crew did not have access to the list of candidates and therefore had no advantage. Once again, the company admits its mistake and acknowledges that it should have opened up the positions to YYZ, since this had been the case for YUL in the first phase.

– We then learn that the process will be delayed and that publication will only take place on October 19.

Finally, the results were published on October 19, blaming the union, while we did everything we could to avoid the chaos. In doing so, the employer creates a division that it relishes every time you publish against your union on social media or on the e-mails you send to us where you vent with the employer on copy. Your employer’s ultimate goal has been achieved!

We hope that after reading this, you’ll have a better understanding of all the steps your union has taken to get to where we are today. We can’t make do with the past, and we need to protect the future from a global perspective. This decision and stance may not please everyone, but it would be different if the people currently affected had taken the chance to apply on the first posting and suddenly 20 people more senior to them were applying on a 2nd posting for the same sub-contract. Since the beginning of this type of sub-contract, the selection process has been the same; Smartlynx is no exception. We played devil’s advocate, turning the file upside down and looking at it from every angle; we always came back to the same conclusion.

If you don’t agree with the lack of transparency, we suggest you contact your SEV to ask them why they didn’t see fit to warn you of the change in position as early as September 29. The union is not responsible for and cannot manage the employer’s communications; only they had the authority to inform you of the changes to their sub-contract.

To date, we are awaiting answers as to why the employer decided to open more positions than the 10 DV and 25 FA provided for in LOU23. Once again, a (bad) surprise!

In accordance with the Air Transat Component Bylaws, anyone wishing to be nominated should adhere to the following information:

Art 11 Members who wish to be nominated for one of the following Component Officer position  shall file nomination papers with at least 50 signatures from eligible voters on the Membership list.

Component officers positions:

1 Vice-President,

1 Secretary-Treasurer,

3 Trustees 

One for each of the following terms: 3-year term, 2-year term or 1-year term

The Component Officer elections will be held January 9-19, 2024.

In December 2023, members will be sent the voting information to their personal email address.

* The term of office for President, Vice-President and Secretary-Treasurer shall be three (3) years, effective January 19, 2024 to January 18, 2027, except for Trustees, who will either fill a 3-year, 2-year or 1-year term.

Help CUPE’s Airline Division fight unpaid work

CUPE’s Airline Division is calling on our 18,500 members across Canada to share their stories of unpaid work, to help bolster its effort to end the abuse of unpaid work in the airline sector.

The Division has prepared a survey where members can share their experiences, which will contribute to CUPE’s application under the Canada Labour Code to the Canada Industrial Relations Board.
